Asharqia Chamber extends its warmest greetings to you and would like to inform you that it has received the letter of the Federation of Saudi Chambers No. (45551795/20), dated (27/1/1448 AH), referring to the Ministry of Finance letter No. (1123), dated (10 Muharram 1448 AH), attached to the Government Tenders and Procurement Law issued by Decree No. (M/128), dated (13 Dhu Al-Qadah 1440 AH). In view of the practices the Ministry has observed that may lead to violations of the Law and its Implementing Regulations, which may result in unwarranted financial claims arising from works carried out in violation of the Government Tenders and Procurement Law, including, but not limited to, “starting execution before the award decision is issued and the contracting procedures are completed by the government entity, executing works and purchases on the basis of verbal authorization, or executing works outside the scope of the contract unless the statutory procedures are completed by the government entity,” and other practices in violation of the Law, and in order to avoid disputes that may arise with government entities and the resulting financial claims and grievances that reach the Ministry of Finance repeatedly and may affect the disbursement of these dues.
Accordingly, the Federation hopes that the Contractors Committee and the subscribers concerned who specialize in the contracting sector will comply with the provisions of the Government Tenders and Procurement Law and its Implementing Regulations, in a way that helps reduce violations, avoid the financial claims or grievances that may arise from them, and preserve the rights of all parties.
